The Appellant was charged with and convicted of burglary and stealing. The High Court sustained the conviction and hence the second appeal to the Court of Appeal. In the Court of Appeal, the Appellant argued that he was not a free agent when he made a caution statement; that the statement was illegal as it was made to a person with powers of arrest (i.e. a police officer); that the house where the stolen properties were found did not belong to him, and that the prosecution witnesses were accomplices. The important question which was considered by the Court was whether the trial court was correct to have acted on the caution statement to convict the Appellant.
