An ex parte decree was entered against the Applicant,
the Judgment Debtor, in Commercial Case No. 130 of 2013 for nonappearance. Upon
being served with the execution order, she immediately attempted to have it
halted through an application for injunction in vain. The Applicant filed this
Application seeking for inter alia extension of time to file an
application to set aside ex parte decree. It is on that regard that the
Respondent filed a Notice of Preliminary objection that the Court is functus
officio to adjudicate the Application.
