The Appellant and two others were convicted and sentenced to
thirty years’ imprisonment for an offence of armed robbery. Aggrieved, they
unsuccessfully appealed to the High Court. Dissatisfied by the conviction and
sentence by the High Court which confirmed the lower court’s decision they
appealed to this Court. The trial court was satisfied by the evidence that was
led by the prosecution witnesses and convicted the Appellant on the doctrine of
recent possession of a cellular phone which was stolen from one Philemon.
However, the cellular phone was irregularly tendered in court by the
prosecution instead of the witness from whom it was robbed.
