The learned Counsel for the Defendant prayed to have the
witness statement, admitted in evidence, however, the witness who was to appear
for cross-examination could not make it. The issue was whether or not the
communication made through an email between the counsel for the Defendant and
the witness has shown exceptional circumstances preventing the witness from
appearing in court.
