The Plaintiff claimed damages and other interests for breach
of contract by the Defendant. The Plaintiff was a carrier who undertook to
transport the Defendant’s goods to India. He alleged that some of the
Defendant’s consignment caught fire and he incurred costs to contain the fire.
He alleged further that the Defendant did not disclose the nature of the goods
in the consignment for shipping, thus he was liable for the loss which
occurred. He prayed that the Court grant him damages as well as redress for the
losses suffered. The court considered the issue whether there was breach of
contract and what reliefs the Plaintiff is entitled to.
