The preliminary objection was filed by the Defendant against
the amended plaint filed by the plaintiff. The preliminary objection is to the
effect that the amended plaint is incurably defective for not disclosing the
jurisdiction of the court. The issue before the court was whether or not
nondisclosure of jurisdiction of the court is fatal.
