The 1st and 2nd respondents entered
into a compromise decree in Commercial Case No. 49 of 2015. It was agreed in
the compromise decree that, the 2nd respondent hands over seven
vehicles and pays USD 60,000 for a dishonoured cheque to the 1st
respondent. The 1st respondent applied for execution of decree for
attachment and sale of the vehicle. The applicant filed this objection claiming
that it has interest in the attached vehicle. The main issue before the Court
was whether or not the applicant has bona fide claim of title of the
vehicles.
