The Appellant was convicted and sentenced to a term of 30 years’
imprisonment by a District Court charged of committing unnatural offence
contrary to section 154 (1) (a) of the Penal Code [Cap 16 R.E. 2002]. Aggrieved
by the decision he appealed to the High Court, the appeal was unsuccessfully
hence this appeal. The appellate Court considered the legality of proceedings,
in the subordinate court, heard partly by one magistrate and partly by another
magistrate.
