The Appellant’s attempts in three appeals to impugn the decision of the High Court decision dated 04.09.2003 were struck out for being incompetent for different reasons. He sought an extension of time which was granted. He successfully applied for a certificate of delay for the purpose of instituting a fourth attempt. The Respondent resisted through a preliminary objection. The three points of objection were briefly to the effect that: the appeal had been instituted out of time, the certificate of delay incorporated in the record of appeal was irregular and the first four grounds of appeal were misconceived in law.
