The Respondent was appointed administrator of the estate of his deceased mother. The children of the deceased agreed on how to share out the estate by consent. This consent order was later challenged by the Respondent. In proceedings that followed, the trial court ordered that the property in dispute should be sold at market price and the proceeds be remitted to court for equal distribution between the parties. The applicants appeal to the High Court was not successful. Being aggrieved by the decision of the High Court, they intend to appeal to the Court of Appeal. They also filed an application for stay of execution. The Respondent argued that the property had been sold and there was therefore nothing to be stayed.
