The Appellant filed a criminal case against the Respondents who were charged with the offence of malicious damage to property. The Primary Court acquitted the Respondents. The Appellant appealed to the District Court challenging the correctness of the Primary Court’s decision and contending that the Primary Court lacked jurisdiction as the matter was civil in nature. The District Court dismissed the appeal. Undaunted by the failure, the Appellant appealed further to the High Court.
