This case relates to a dispute of double sale of a piece of land located Nyakato Mshikamano within Musoma Municipality. Each party claimed to have purchased the disputed piece of land from the same vendor, one Jera Mapesa. The dispute was initially filed in the Nyakato Ward Tribunal, which decided in the favour of the Appellant. The Respondent appealed to the Musoma District Land and Housing Tribunal which reversed the decision of the Ward Tribunal and gave judgment to the Respondent. The present Appellant was aggrieved and thus decided to appeal to the High Court. The issue before the Court was who is the rightful owner of the disputed land.
