Appellants were charged with two counts of burglary and robbery with violence. The trial District Court convicted all the four accused persons and sentenced them to three years’ imprisonment. Aggrieved, by the decision of the District Court all the four accused persons appealed to the High Court where the appeal was dismissed in its entirety. Undaunted, only the three Appellants have appealed to the Court of Appeal. The main ground raised by the Appellants was that the High Court and District Court erred in law and fact to convict the Appellants relying on unfavourable conditions of identification.
