The Appellant was charged with and convicted of murder. He was sentenced to the mandatory death penalty. He was aggrieved and appealed to the Court of Appeal of Tanzania. The chief complaint in his appeal was identification. It was argued on his behalf that the evidence of his identification was not watertight. On the other side, the Counsel for the Respondent submitted that the Appellant was sufficiently identified and his actions of running away coupled with his confused answers corroborated other evidence and thus supported the conviction.
