The Appellant successfully sued the Respondent at Mombo Ward Tribunal through Majid Daud Mbura in favour of whom a special power of power was dully executed. During the hearing at the trial tribunal, the Appellant appeared and testified that despite the presence of Majid Daud Mbura, his recognized agent, the appellate tribunal quashed the decision of the trial tribunal on the ground that it was wrong to allow the principal to appear and testify together with his agent, hence this appeal.
