The plaintiff sued the Defendants for breach of a joint
venture agreement entered into between the Plaintiff and the 1st
Defendant. There were allegations of involvement by the 2nd
Defendant in the agreement between the Plaintiff and the 1st
Defendant. In their joint written statement of defence, the Defendants raised a
preliminary objection to the effect that the plaint did not disclose a cause of
action against the 2nd Defendant.
