The Plaintiffs’ claims against the Defendants inter alia
for the physical recovery and possession of a container holding 204 bales of
clothes imported from China and payment of TZS 40,800,000/= being loss of
expected earnings. Although the container was released by the customs the
Defendants refused to deliver it to the Plaintiff’s agent and hence this suit.
The Court considered, among other things, the status of a bill of lading, the
seller’s right to stop delivery of goods and resell them, how much damages are
recoverable in case of breach of contract and the right of depot operators to
withhold cleared cargoes.
