The Appellant was charged with and convicted of rape. He was
sentenced to thirty years’ imprisonment and corporal punishment of four strokes
of the cane. His first appeal to the High Court at Tanga was unsuccessful,
hence this second appeal. In his appeal the Appellant had one ground namely
that he was not asked if he had any objection to the admission of the caution
statement. The appellate court considered this ground and also whether failure
to so inform the Appellant of his right prejudiced him.
