The Applicant who had lost an appeal in the High Court of Zanzibar applied for leave to appeal to the Court of Appeal of Tanzania. He faulted the decision of the High Court and two subordinate courts below it on evidence and prayed for leave to appeal. On his part, the Respondent submitted that the intended appeal had no chances of success as there were no legal or fundamental legal issues to be resolved by the Court of Appeal. Having heard both sides, the Court of Appeal considered whether the intended appeal had any chances of success. But before resolving this question, it discussed the guiding principles for applications of this nature.
