The Appellant was charged with and convicted of being in unlawful possession of bhang in the Regional Court at Vuga in Zanzibar. He was convicted and sentenced to 15 years of imprisonment. He appealed to the High Court of Zanzibar which dismissed the appeal but reduced the sentence to ten years for what it described as the Appellant was “suffering from pain in his body for some time now.” The Appellant further appealed to the Court of Appeal of Tanzania contending that the High Court’s judgment lacked essential requirements of true judgment; it failed to analyse evidence properly; the case was not proved beyond reasonable doubt as the exhibit was tempered with, as it was not handled as required by the Police General Orders; and that evidence of police officers was not credible.
