The applicants by way of chamber summons made under rules
29(1) and (2) and 24(1) of the High Court (Commercial Division) Procedure
Rules, G.N. 250 of 2012 and any other enabling provision of the law lodged the
instant application against the above named Respondent praying that, this
honourable court be pleased to grant, among others, the following orders,
namely:
1. This
honourable be pleased to vacate its scheduling conference order made on 19th
July, 2019, in respect of Commercial Case No. 44 of 2019 between parties
herein.
2. An order
granting leave to the applicants to amend their joint written statement of
defence (WSD) filed before the Honourable court with a view to amend to add
more particulars to the amended WSD to address the plaint more clearly in
respect of Commercial Case no 44 of 2019 between parties herein.
Upon being served, the Respondent, filed a counter affidavit
stating the reasons why the orders sought should not be granted. A reply to
counter affidavit was equally filed stating and insisting for the grant of the
orders sought in the chamber summons.
