The applicants with assistance of their advocate lodged this
application under certificate of urgency, calling for an urgent hearing of this
application for bail pending final determination of the Economic, Case No. 01
of 2020 in the District Court of Nanyumbu at Mangaka. The two applicants are
jointly facing two counts of stealing by agent contrary to section 258 and 273
(b) of the Penal Code and count two is occasioning pecuniary loss to a
specified authority contrary to paragraph 10 (1) of the First Schedule, section
57 (1) and 60 (2) (3) of the Economic and Organized Crime Control Act [Cap 200
R.E. 2002], read together with section 55 (13) of the Cooperative
Societies Act No. 6 of 2013.
Being so arraigned in court and since their charges involve
economic offences, which bail application is under mandate of this court, then
they so decided to apply for bail pending trial. This court being so moved,
invited parties to appear and argue their case.
