The applicant instituted the application in which they prayed that the Court strike out the notice of appeal which was lodged by the Respondents, Hood Transport Limited and Scania Tanzania Limited, on account of the latter’s’ failure to take essential steps in the proceedings. They said the Respondent did not collect the necessary documents they had applied for, which was why they had not filed the appeal to date.
