This is a ruling in respect of an application made by applicant for issuance of arrest warrant against the Respondents to appear in court and show cause why they should not furnish security for their appearance and costs. The application has been made under the provisions of Order XXXVI rule 1 (a) (iii) and (b) of the Civil Procedure Code [Cap 33 R.E. 2002] and supported by the affidavit of the applicant’s officer. It is resisted by a joint counter-affidavit of the Respondents.
