The applicants lodged the present application seeking the
indulgence of this Court to extend time within which to file an application for
stay of execution of the judgment and decree of the High Court. Before the
hearing started the Respondents, raised a preliminary objection against the
application to the effect that, the motion be dismissed for failure by
applicant to file written submissions in support of the application. The Court
overruled the preliminary objection and proceeded with the hearing of the
application. The main ground for application for extension of time by the
applicant was the delay caused by filing the matter in the wrong court. The
issue before the Court was whether the applicant’s ground for extension of time
amounts to a good cause.
