In this application the applicant is seeking revision
against the decision of the High Court. The centre of the dispute based on the
legality or propriety of the sale of disputed land. The High Court gave an
order for execution of a decree in favour of the first Respondent. The disputed
property was attached and sold by the court broker. Aggrieved, the applicant
instituted objection proceedings before the Court seeking to set aside the sale
on the ground that, the disputed property was wrongly attached and sold as it
did not belong to the judgment debtor but the late Ibrahim Ayoub Bachoo. The
application was struck out for being time barred. Later on, the applicant
unsuccessfully lodged two further applications. One of the application which is
subject of this application was dismissed, hence, this application. During the
hearing the Respondents raised preliminary objections, among others, the
application does not include copies of the impugned ruling and drawn order of
the High Court. The main issue before the Court is whether or not the
application before it is competent.
