The Respondents successfully sued the Appellant in the High
Court for negligence following carrying out mining activities in the Appellant
premises, which resulted into the Respondents’ suffering of pain, respiratory
infection and permanent disability. Dissatisfied with the decision of the
Court, the Appellant filed this appeal.
