The Appellants were arraigned, charged, convicted and
sentenced to the mandatory penalty of death by hanging for the offence of
murder contrary to section 196 of the Penal Code [Cap 16 R.E. 2002], by the
High Court at Moshi. Dissatisfied with the decision of the Court, they appealed
to the Court of Appeal, hence, this appeal.
