The application was challenged by the Respondents through the affidavit in reply of Patrick Mutabazi Nyindo, the principal officer of the Respondents. The hearing of the application was preceded by a preliminary objection raised by the Respondents on the competence of the application on the following grounds, inter alia, that the affidavit supporting the Notice of Motion is bad in law for containing extraneous matters in form of arguments, conclusion and opinion.
