The Respondent in this appeal did by her attorney file Civil Suit No. 71/2007 in the Land Tribunal at Forodhani against the Appellant. The Respondent instituted the suit against the Appellant praying to be declared the rightful owner of the plot in dispute and that the Appellant be ordered to vacate the plot in dispute. In his written statement of defence the Appellant denied the Respondent’s claims stating that the plot in dispute does not belong to the Respondent but to his sister. He also denied to have been an agent of his father in the sale transaction as claimed by the Respondent. The Appellant also claimed that the Respondent breached the sale agreement by failing to pay the agreed sale price in full within the agreed period of time. The tribunal unanimously decided in favour of the Respondent hence this appeal.
