The first respondent sued the second, third and fourth
respondents over ownership of a registered piece of land in the High Court. The
High Court declared the first respondent to be the owner of the disputed
property. The same property once happened to be owned by the Appellant as it
was disposed to him by way of sale by the 2nd respondent. The
Appellant was neither a party to nor aware of the suit in the High Court.
Dissatisfied, the applicant filed this application moving the Court to nullify
the trial proceedings on account that she was condemned unheard.
