The Plaintiff is the owner of the premises situate at
Industrial Area, Msalama, Songea, comprised in a Certificate of Title No.
8091-MBYLR. He leased the same to the Defendant for a period of 20 years for
business purposes. Contrary to the terms of the lease, the Defendant used the
Certificate of Title to obtained financial and economic benefits by mortgaging
the same, without the Plaintiff’s consent or even knowledge. The Plaintiff
claims for breached of the terms of the lease and unjust enrichment by the
Defendant.
