The dispute was centred on the communication towers installed by Zain (T) Ltd. on the Respondents land. They were aggrieved as the street leadership was the one receiving the payments from ZAIN on allegations that the said area belonged to the street leadership and it had signed the Agreement with Zain (T) Ltd. It was very clear that what was being sued was the street leadership.
The facts leading to this appeal were to the effect that at the trial ward the Appellants were sued contrary to the provisions of law. The Appellants were dissatisfied, thus the decision of the District Land and Housing Tribunal was subjected to challenge in the High court by the Appellants where they filed one ground of appeal to the effect that; both the Ward Tribunal and the Appellate District Land and Housing Tribunal grossly misdirected their mind by entertaining the matter brought against the Appellant who had no legal personality.
