THE GRAND ALLIANCE LIMITED v. MR. WILFRED LUCAS TARIMO AND OTHERS

The Plaintiff and the 1^st to 4^th Defendants entered into a Share Acquisition Agreement for the purchase by the Plaintiff of the 1^st to 4^th Defendants’ shares in the 5^th Defendant Company. It was agreed that by purchasing the shares in the 5^th Defendant Company, the Plaintiff would automatically be entitled to all movable and immovable assets of the 5^th Defendant Company, but the Defendants have failed to do so. The Plaintiff further claims that, the Agreement was arrived at through fraud and/or non-disclosure of material facts perpetrated by the Defendants.
