The plaintiff applied for a loan of Tshs. 32,000,000/= from
the 1st defendant for the purpose of buying a tractor to be used in
his farm area at Lupondo Village Makamba Ward, Mkuranga District, Coast Region.
His application was granted on 19th November, 2004. He was then
directed by the 1st defendant to correspond with the 2nd
defendant for being given the loan. He did so but the 2nd defendant
refused to give him the loan. Consequently, he sued both defendants for breach
of contract. The issue before the court was whether the plaintiff entered into
contract with the first or second defendant worthy of breach.
