All the plaintiffs herein were owners of properties in
neighbourhood of a military base in Mbagala. Following the explosion of several
bombs in the military base, there were loss of lives, destruction of properties
and damage of the plaintiffs’ properties. Following discussions with the
defendants, some compensation was paid to them by the Government between August
2009 and July 2010. However, the plaintiffs considered this compensation
inadequate, “incredibly small and unreasonable”. It was for this reason that
the plaintiffs have filed this joint action. Upon hearing the application, a
preliminary objection was filed by the Respondent contending that the
application was time barred.
