The Appellant was convicted and sentenced to thirty years’
term of imprisonment for committing rape contrary to section 130 of the Penal
Code [Cap 16 R.E. 2002] by the District Court. Aggrieved by the decision of the
District Court he unsuccessfully appealed to the High Court hence this second
appeal. On this appeal the Appellant advanced several grounds of appeal but
mainly contended that there was no sufficient evidence to sustain the
conviction because the evidence of the complainant was not properly taken and
there was no evidence to corroborate that evidence. He also contended that the
witnesses were related hence not competent to testify on the case.
