The Appellant was aggrieved by the decision of the District Court of Kinondoni and decided to appeal to the High Court which allowed the appeal. The grounds for appeal were: that the trial court erred in law in making the decision relying on defective petition. That the trial court erred in law in making the decision while the Appellant had a lawful marriage with another woman. That the trial Magistrate erred in fact in making the decision awarding division of matrimonial assets at the rate of 40%:60% with no evidence proving the existence of the alleged matrimonial assets.
