The Applicant filed a notice of preliminary objections against the Respondent after the Respondent filed the counter-affidavit that was time-barred and without the leave of the court. Furthermore, the Applicant contested that it is bad in law for the Respondent to be represented by the advocate who had previously attested the Applicant’s affidavit.
