The Respondents sued the managing director of Total Tanzania Limited in the District Court at Tanga for the following reliefs in respect of alleged underpayment of wages: Tshs. 3,129,641/= to each of the 1st and 2nd Respondents, Tshs. 2,907,348/= to the 3rd Respondent, and Tshs. 292,400/= to the 4th Respondent. The Respondents further claimed 0.06 per month as annuities and interest from the date of judgment till date of payment in full at the rate of 7% per annum. The trial court granted all the reliefs as prayed. In this appeal, the issue is whether it was proper for the Respondent to sue the managing director of the company for the claims against the company.
