The Appellant herein had been a headmaster of Bihawana Secondary School whereas the Respondent had been his Subordinate teacher. The Respondent alleged that it was the Appellant herein who had engineered and manipulated her transfer. The Appellant withheld her salary and had uttered defamatory words against her. Lastly, it was alleged that the Appellant refused to pay the Respondent her subsistence allowance following her transfer. The Appellant denied that he uttered the alleged defamatory words which evidence was supported by DW2 and DW5, both then teachers at Bihawana Secondary School, who said they were present at the staff-room on the alleged date. The trial court found that the Appellant uttered the alleged statements and that they were defamatory against the Respondent and lowered her reputation. Also it was found that the Respondent’s salary had been unreasonably withheld by the Appellant. As for payment of subsistence allowance, the trial court was non-committal on the issue and answered partly in the affirmative and partly in the negative. Lastly, the trial court held that there was no evidence to prove that the Appellant engineered the Respondent’s transfer. The Appellant was aggrieved by the trial court’s decision, hence filed this appeal.
