A preliminary objection was raised against an application asking the Court of Appeal to revise and nullify the proceedings of the High Court in High Court Commercial Case No. 16 of 2000. It was contended that the Applicants’ application for revision was an abuse of the process of the court as an appeal was already filed in the Court of Appeal in respect of the same judgment. The Court considered whether it could be formally moved to exercise its revisional jurisdiction under section 4(2) of the Appellate Jurisdiction Act [Cap 141 R.E. 2002].
