The Appellant was charged with and convicted of robbery with
violence by the District Court of Magu. His conviction was based on visual
identification. His appeal to the High Court was dismissed. He further appealed
to the Court of Appeal complaining that he was convicted on the basis of
evidence of visual identification which was very weak. The Court considered the
ground raised and also whether the appellate court could interfere with concurrent
findings of fact of the lower courts.
