This was an application for revision of the judgment and
decree of the High Court of Tanzania in its appellate capacity, sitting at Dar
es Salaam. In that appeal the court ordered, inter alia, that the
purchaser, his or her agents, relatives or any other person to be evicted from
the house subject of dispute in this matter. The applicant, Saida M. Mnyone was
a purchaser of the property in a public auction, the subject of dispute in this
matter. The property in issue formed part of the estate of the Respondent’s
deceased father. The applicant who was not a party to the proceedings in the
High Court was not given an opportunity to be heard by the High Court which
declared her purchase of the property dubious and consequently issued an
eviction order against her. Her complaint therefore is that her fundamental and
constitutional right of being heard has been violated.
