The ruling emanates from the Preliminary Objection raised by
the Counsel for the Defendants contending that this Court lacks jurisdiction to
continue entertaining the case since the Scheduling Order has expired and the
Plaintiffs have failed to apply for its extension, he therefore prays the suit
be struck out with costs.
