The Appellant was charged with and convicted of murder. He
was aggrieved by the decision of the High Court and appealed to the Court of
Appeal. He challenging the decision of the High Court on two grounds. The first
ground was to the effect that the trial judge erred in his findings that the
prosecution had proved its case beyond reasonable doubts purely basing their
proof on circumstantial evidence. And the second ground was that the trial
judge misdirected the assessors by giving his opinion first which eventually
influenced the assessors in their opinion.
