The Plaintiffs have sued the Defendants claiming for
Tshs. 201,100, 000 plus general damages following a breach of sale agreement on
construction equipment. The Defendants filed three grounds of preliminary
objection, firstly, that the plaint filed in court does not disclose any cause
of action against the Defendants, secondly, that the plaint filed in court is
bad in law and ought to be struck out with costs and thirdly, that this court
is not vested with jurisdiction to entertain this matter as the cause of action
arose in Mtwara.
