The applicant, was seeking the court to quash the conviction
and set aside the sentence of death by hanging, imposed on him by the High
Court and upheld by the Court of Appeal. The applicant was aggrieved by the
decision of the Court which dismissed his appeal for want of merit. He faulted
the conduct of the trial in the High Court saying that it was conducted in
English, a foreign language he does not understand; that Mr. Sangawe, learned
Advocate who represented him, did not effectively defend him and also that Mr.
Sangawe did not confer or get instructions from him before the commencement of
the hearing of the appeal and that the review be granted in the interest of
justice.
