The Appellant was found
guilty and convicted of stealing by servant and was sentenced to three years’
imprisonment term. After the prosecution had closed its case the learned trial
District Magistrate cancelled Appellant’s bail without giving reasons for
taking that stern measure. It is on record that in protestation the Appellant
submitted that he had no confidence in him on the one hand and the public
prosecutor on the other and asked him to disqualify himself from continuing
with trial of the case on the ground of apprehension of bias. The trial
magistrate however, declined to disqualify himself and proceeded with the case
to its final conclusion which resulted in the Appellant’s conviction and
sentence. The Appellant is appealing against that conviction and sentence.
