The Appellant became victorious during the parliamentary
election that was conducted on 14th December, 2005. The results were
contested by the respondent by filing an election petition which was upheld by
Mchome, J., by annulling the election on the stance that there were corrupt
practices done by the Appellant. Being aggrieved by the decision of the High
Court, he has filed this appeal. The issue for determination before this court
was whether the corrupt practices were proved beyond reasonable doubt, i.e.,
allegations were proved to the required standards.
